Actually, there is present controversy over whether an insider is liable while he possesses material info and trades. Many think that under present law you're liable only if you USE the info. There is a proposal to change the rule in the pending proposed rulemaking on selective disclosure promulgated by the SEC in March.

Cablelabs never removed S-CDMA from possible future inclusion in DOCSIS. At all times since TERN was first invited to submit S-CDMA, a DOCSIS revision number has remained in the cards for S-CDMA DOCSIS inclusion if and when an S-CDMA prototype is submitted and accepted. All notions to the contrary implied and/or flatly stated in the suits, are wrong. There is an excellent chance the cases will be thrown out, IMO.
