I read the entire press release very carefully several times. My interpretation can be found at messages.yahoo.com

If you read the sentence that you posted without consideration for the rest of the press release, you can come to the wrong conclusion. I think that the stock will rally because I suspect that buyers have been scared that the ruling might go against Gum Tech. This could have contributed to a lack of bids, and the overall down market had a greater than normal effect on the stock. I believe that GUMM is trading at a ridiculously low valuation. When the stock got to 8 the other day, it was trading below the price when the news of Zicam first leaked. This means that the market was giving zero value (or even negative value) to Gel Tech, even though the company is in much better shape now than it was ~18 months ago when it last traded at 8.
