I read Tribe's op-ed piece in the New York Times. Interestingly, he points out that even if the Court grants Elian asylum, that doesn't mean his father can't take him back to Cuba. I doubt he's right. He also doesn't suggest what the Justice Department should have done that would have been superior to getting the search warrant. The Florida family court had already ruled (correctly) that only the INS had jurisdiction to determine where the boy went, so the asylum petition was the only thing that was keeping Elian in this country. The INS didn't need for a judge to rule, by law they have jurisdiction over illegal aliens. The 11th Circuit expressly declined to rule on where Elian lived during the pendency of the appeal. So no court had taken jurisdiction of the matter.

I would be very surprised if Tribe isn't acting as a consultant for the Cuban-American interests, but we'll see. Maybe his opinions are not advanced for the interests of a client.

I am enthralled to see Rudi Giuliani and Tom Delay forming an alliance with Lawrence Tribe. I hope they remember to contribute to the ACLU, it can always use more civil libertarians. I think in the long run they'll be sorry that they liberalized the law, but if they do amend the laws to protect individual interests more, I won't object. I don't like the militaristic overtones that are involved here, but no one seems to mind when it's Haitians.

You would be right to come as a puppy. However, I am not sure that responsibility in this matter is contingent on Elian's "kittenishness".......
