The legal issues and facts about the seizure aren't perfectly clear to me as I've read differing statements. I'm not sure Lazaro had legal custody to keep Elian when his father was in the country wanting him back. I do know there is a court order preventing Elian from being taken out of the country till his asylum request is resolved one way or another. As to whether the INS had the appropriate authority to enter the house to seize Elian, I don't know. The fact that they were entering to seize an alien rather than to search for evidence of a crime may make a difference. Let the Congressional investigation resolve that.

The best thing that could happen to Elian would be if his family now in the U.S. would request asylum. While I don't think this family would be persecuted back in Cuba due to the media attention they've received, an asylum request coming from the father would probably be successful anyway.
