Actually- according to the asylum law I have been reading- he can speak for himself- with an adult present. Will he be able to comprehend the questions? Who knows? The child asylum guidelines are mainly set up for refugee, separated or orphaned children- not for children like Elian- who, but for his Miami relatives, would not be seeking asylum.

What will happen, I suspect, is an ALJ will question Elian. Elian won't have a clue about asylum. Elian will say he wants to be with his dad. Asylum will be moot- and he will live with his father. If the ALJ determines that Elian understand and wants to keep his asylum case active- that will be a problem. That presents a nasty question of international law (imo) because if the mother abducted Elian without the father's knowledge or consent then you have an international criminal act leading up to Elian's presence here to seek asylum. It's a tough question at that point.
