This document is the prospectus for Neopoint, and it clearly references the '94 agreement between IDCC and QCOM:

"...every patent issued on or before March 7, 1995"

(IDCC's essential IPR for CDMA2000 was developed after 3/7/95)

"...The license under InterDigital's Patents is limited to use in Wireless Applications which spread the CDMA signal over not more than a 10MHz bandwidth."

(The ITU calls for a spread larger than 10MHz)

That is further backed up by a telephone call I made to IDCC today. I was told that IDCC has technology which intersects CDMA2000. Most notably, Pilot Code Standard claims and certain Power Control claims.

You may wish to contact them yourself. They will tell you the same thing I was told.
