Have you been around 6 year olds much? They have tremendous trouble deciding whether lunch should consist of pizza or hot dogs; they want to color all day one minute, and watch TV the next. A 6 year old lacks the capacity to make an informed decision as to what country to live in.

Also, the Lazaro family is not a Cuban-American success story: a drunken uncle (more than one actually), cousins who dabble in armed robbery, a female cousin who even before this has a history of being hospitalized for hysteria. Does Elian know about all of this stuff? It would be important to his decision as to who to live with, but how could we explain Uncle Lazaro's multiple DWI convictions/alcohol problems to a 6 year old?
