According to cnbc the doj wants a 3 way split, adding to the first proposal a 3rd company for the browser. That probably would help the stock if msft could begin charging for the browser, bringing in more revenue.

Sounds like they're getting worried, but the Judge saw it as too little, too late, IMHO.

The judge may just hint that he wants MSFT to spin off the IE browser and keep the rest as a unity, since this is the original problem. This way he will do a big favor to everyone. This might just be my wishful thinking.
