Under such conditions, private enterprise has more freedom to act.

Don't forget that, under such conditions, individuals have more freedom to act, too.

Take the IRS for example, for some reason, they keep on making the code ever more complicated, so planning for changing tax rules, makes it quite difficult to have any sort of long term planning.

In the interest of balance of powers, fairness, and all that good stuff, it's Congress that writes the code, not the IRS. I would imagine the IRS is even more frustrated by all the changes and contradictions in the code than you are.
