Any really astute lawyers among gemmers? I want to go after "Stuart's" firm Ameritrade...they swiped $800+ from me when I bought an ALKS call option at 2 3/8 in the morning and entered a sell order at THE MARKET at 3:30 the same day when the call was quoted 10 7/8's bid by Ameritrade and also by Pru-Bache. They told me that they were "unable to sell the call option at THE MARKET." This was outrageous...I know that I was not going to get the 10 7/8 bid, maybe 10, maybe even 9, I know how options-dealers "work" with market orders. I spoke with several trader friends on the Street and they'd never heard of a MARKET order that was not executed. Nor had I, in several decades of trading. "Sorry" was Ameritrade's response. Then the order to sell the call option suddenly disappeared from my trading page. "Pull up the tape of my conversation...the fellow I spoke with knew the order was placed...went to get me the fill after I'd waited for 20 minutes. "Who was the fellow you spoke with" said another chap. "His name was "Chris". "Well golly, we have 20 guys named Chris here and without his last name there's no way we can pull up the tape." I was rather frustrated and very incensed.

If I was a "killer"-lawyer I'd file an injunction, try to shut them down, sue them for 10 million...this might get their attention...and resolve the "problem"...forthwith.

Or, I can take them to small-claims court in Mass. But they are located in Omaha, Nebraska. Do they have to show up? I think not. A judgement may be entered against them...and they can ignore or forget it. Am I correct in this?

I have all the documentation...printed out.

I can also post the entire scam on the internet...warning others of what happened to me...and letting others know what might happen to them. Is this advisable?

I'd appreciate any help. (Lee)
