Are you sure? I emailed the IRS and they came back with this:

"In my opinion, the time frame (expiration) is the only truly distinguishing characteristic. While we could argue that the price also differs, that's just the volatility of the market affecting the price of the stock/option. Since the time frame is relatively short, in my opinion, it favors the conclusion that the securities were substantially similar. I'm relatively sure this would be the government's contention should this issue be the subject of an audit..."

30-day wash rule.

What about securities trades in an IRA, since you aren't claiming a gain or loss until you remove the funds is there a wash-rule of some sort involved?
