Well, ultimately God did. Proximately, it was discoverable through our effort to employ reason in regulating our social interactions. It rests on certain postulates, such as that human beings matter as individuals, that they should be respected, and that they are accountable for their actions. Whether or not those postulates are true, or merely useful fictions, they are the fundamental terms of moral community. Thus, the postulates and deductions derived therefrom, though they may be refined, are not merely arbitrary.

I mention the majority merely because you asserted that eliminating the death penalty would conform better to our sense of fairness.

I saw Miss Julie on video last night. I'd forgotten how deeply depressing Strindberg is. But on the lighter side (sort of) I saw Man in the Moon. If you get a chance do see it. I'd put it off and I was sorry I had. It was a really brilliant bit of acting AND a truly compelling story.

Of course the majority, lacking the civilizing influence of the fine arts, will always prefer revenge, which is what capital
punishment is. It feels good, and that is very compelling to the unrefined.

Do the refined ever venture their opinion on how poorly murder victims fare in the justice system versus their murderers? Where's the balance?
