Yes, that is correct. The Govt is desperate to avoid the appeals court. These guys are out for blood. IMHO, this just means that the case will be referred to the supreme court by jackson since he is a puppet of the govt. Then we will see if the supreme court decides to take it or if it decides to refer it to the appeals court.
In any case, I think that if the conduct restrictions are stayed either by the appeals court or the supreme court, the govt will ultimately lose, else they have a shot.
