Scumbria, "wonton infringement" always bear triple damages. If you do not want to use the IP, fine, but using it despite the knowledge your products infringe (and probably in violation of a non disclosure agreement), is thievery and is punished by law with treble damages.

Triple damages apply because Hitachi would not even talk to Rambus about its IP. Hitachi walked out and said screw you.
This blatant action is what makes Hitachi liable for triple damages. IMO triple is not enough.
I fail to see your case that this is extortion.

Let's roll back the clock please.
I bet Hitachi feels stupid right now for not buying Rambus outright back in Dec for say 5-10B when RMBS market cap was under 1B.
