I think you're talking power, not fairness. I would like to think that there exists a concept of fairness that supercedes the power of the machine gun. For the obvious example, I don't want to think the majority of Germans thought that Hitler's treatment of the jews was fair, or that the world will accept it as being in any way fair in any context just because he had the power to do it.
