What ends up as "fair" is what is allowable by both/all sides. "Love and War are the same thing, and strategems and policy are as allowable in the one as in the other." So I say it falls into company with "pornography" and you simply know it when you see it, whether you have standing or are a bystander. If anyone should be acutely aware of this it is a lawyer; that is their trade, fair treatment before the law.
