You don't even need a witness. Phil Hartman's wife murdered him as he slept. She then committed suicide. Was she not a murderess because she killed herself before the law could sanction her for murder?

Witnesses can be mistaken. I once witnessed a hit and run car accident at night. Later in a report to the police I discovered one witness thought the car was green, another blue. I thought it was black. Turned out we were all wrong. It was red. One of the witnesses had remembered the plate. Sure enough, that info was right. Sometimes what we think we see is not what we are seeing -- especially if someone is being raped or murdered right in front of you. The mind can play tricks.
