He would lose custody if he were found unable to support the child and were declared mentally incompetent. At least, that is what he says he believes. The child is a six year old girl who earns a modest income by modeling (her mother's boyfriend is her agent). She and her father share a one room apartment rented for them by friends and relatives. The mother is busy with her new boy friend and their new one year old child and the California bar exam and claims to be unable to care for the child for which she and the father share legal custody. I am sure there is a bad novel there.
