Per your reference, it seems the system, flawed as it is, works.

Incorrect judgements were thrown out, penalties were reduced, lives were saved in the cases where procedural errors resulted in re-trials.

....the overall rate of prejudicial error in the American capital punishment system was 68%.
Nowhere does it say an innocent person was executed.

I read this report (prejudiced as it is) as a supporting document for the present system. It shows that we provide checks and appeals to protect against executing the wrong person. Even to the point of spending great amounts of capital and time.

What else could we do in such a grave situation?

Yet, those who have exhausted all avenues of appeal, numerous times, and have their sentences consistently affirmed by all reviewers ~ should expect to see their sentences carried out.
