The merger talks were initiated by SDLI CEO D. Scifres. That has suprised me.

Here is a quote from this updated Bloomberg story.

JDS's completion of the E-Tek acquisition on June 28 sparked the negotiations, said SDL Chairman and Chief Executive Donald Scifres, who initiated the talks.

``Joe, I see you just closed on E-Tek and it's time we should get together to talk,'' the SDL chairman said he told Straus.

I think this merger will involve more scrutiny.
However, since DOJ got a decent education from the just concluded JDSU-ETEK merger about the technology and players involved it should be relatively easy to educate those lawyers again.

In the end JDSU may concede some divesture/sale of units to get the approval.

IMHO it may take a little longer than what JDSU would like to as there may be some indirect pressure from LU, GLW and even CSCO about keeping this merger stopped. With less suppliers and a very hot demand for the components, combined company will demand higher price for the components.
With this merger JDSU will be able to bite the bullet of supply glut which may occur within another couple of years, as all major players are aiming to increase their production capacity.
Hope JDSU will approach the DOJ with a better proposal as a preemptive move before those lawyers start demanding concessions based on what all "sour graps" will keep feeding.

As a JDSU long I don't see my shares going anywhere for another few months.
