I recall Milo Medin, CTO of ATHM was asked about this at Gilder's Telecosm '99 (Sept. '99). He indicated that at that time, there was a limit enforced on the upsteam bitrate that was significantly lower than than the downstream rate. They had run into a problem in their Fremont,CA build among other systems wherein certain users were violating terms-of-use clauses and utilizing their home based systems as servers, completely overwhelming the network at times. Sorry, but I don't recall the bitrate figures, it's been a long time since I followed that webcast.

So, I believe Jay's concern about the under-capacity of the ATHM network to handle large flows of DVD files is prescient.
