What proof do you have that the part sent to Tom PabstSmear wasn't working properly when he received it?

The part works at <850MHz, but not at any higher speeds. This is an indication of a speed problem, rather than a defect. Had the part been mishandled, the symptoms would be non-functional, rather than slow.

To suggest that Tom damaged the part is absurd.

The bozo spent one day ranting and raving about a BIOS MICROCODE Issue - then the next day retracted that accusation - saying that a BIOS/Microcode issues wasn't the problem.

He made the mistake of giving Intel the benefit of the doubt. That will teach him.

You are grasping at straws.
