Yes and isn't that a great thing? If the government can't protect us then at least we can protect ourselves. It's what makes America great. Prohibition doesn't work but we have legal remedies when we are poisoned by a legal product used in the way it is recommended by people who know the consequences of that use.
I love your libertarian streak, Brian, but you are trivializing it with this issue.

But it's O. K. for a smoker to go off by himself and do
it where he's not bothering anybody, right?
I suppose it's also a smoker's right to subject people
who love him to the abject grief they feel
while they watch him slowly drown in his own blood while
his heart beats fiercely trying to supply oxygen to his
ice cold fingers and toes. I suppose so. After all, we've
all got our rights, don't we?
