#1: So what? That he was posting and bashing CYBR since January, along with the content of exactly WHAT he was saying in his posts, is very VERY important, Barbie Doll. You see, this shows that he was not only familiar with the issue, but that he intended to short it, and that - by extension - he possibly would bring others in to short it CONTEMPORANEOUSLY with him. Did you short it contemporaneously with him on February 23rd? Be careful answering.

#2 I'm sure anyone who Auric "induced" into shorting CYBR is grateful. I doubt that having and publishing an opinion on a stock is a violation of securities law, registered or not. You're quite wrong. If he were, as a legitimate broker, publishing these opinions while disclosing his identity as a broker and disclosing possible conflicts of interest, your point might be defensible. As it stands, because he was posting anonymously, your point is utterly indefensible. And anyone contemporaneously shorting the issue with him may be guilty of the charge of fraud as price manipulation.

#3 Irrelevant You simply MUST be aware that it is in violation of NASD rules and regs for a registered broker to post to public message boards and in chat rooms withour disclosing his status as a broker and any potential conflicts of interest
