If that happens, file a complaint with your Commissioner of Insurance. Also, a lot of states have laws that give you a cause of action for wrongful failure against insurance companies, to provide insurance coverage. The one in Virginia has teeth, I think you can get attorney's fees and punitive damages.

Coincidentally, K just got me a case defending a trucking company that let their insurance lapse and are being sued for an auto accident case. Of course I will double check to see if the coverage really did lapse, but in the meantime this is good money for me.

My car got rear-ended while stopped and the vehicle incurred minor damage. Driver admits fault - no contest. If I report it and get a police report, I get a point, whether or not it is my fault. SO, I elect to not have it fixed to prevent myself from being assessed a point because involving the insurance company of the guy who hit me automatically involves my insurance company. Catch 22. Now why do I pay insurance? To not report accidents reported against other insurance companies? Hmmm.
