Dave B, That's how I read it. The question is what is fair? I don't know for sure, but I would think that Micron wanted a better deal in their negotiations with Rambus. I further think that Rambus realized special deal would present problems with antitrust laws. Rambus' position would be what was good for Hitachi, Toshiba, etc. should be good for Micron. I think that this must have lead to a breakdown between them. Micron being pissed threw up their hands and said we're going to sue. We feel what you are asking for is not fair... you are asking for excessive royalty rates.

I also think that if Rambus had said OK to a special deal Micron would have turned around and used this against Rambus in a court of law.

Of course this is all speculation on my part. I know special deals are made, but I don't think you can charge different royalty rates among your customers in this type of situation. But I could be wrong. An attorney will have to answer many of our questions. I'm sure we will hear more.
