There is a "legal" rule for every thing judicial society wants to do, and if it can't find one that fits, it will create a new one. This is necessary to keep people from shooting each other.

I know this is spitting into the winds of myth in this country, but everyone should realize that there is no magical elixir within the local court house. Which is to say the legal system is not digital in nature, it is never "0" or "1" and nothing more; we are analogue; a nation of men; definitely not a nation of clearly defined rules of right and wrong.

Think "frequency" and "cyclical" trends when you think of The Law. Think "politics" in every sense of the term. Think here today, gone tomorrow.

And in so far as this particular "rule" is concerned, think very tough road to hoe for RMBS because JEDEC isn't suing them MU and Hyundai are.

But be not dismayed. For it is written: "A chicken in every pot and two rules of law for every litigant."<vbg> ...At least until the verdict is read. :8)

Presently, in the absence of ALL the facts, my view on this mess is informed by three things:

1. The question of what Tate will say when questioned under oath by opposing counsel about his understanding of the nature of JEDEC before he ever sent his staff to "break" bread with them.

On this point Tate will have to have a "story" to sell the jury which is at once credible and logical. We know what the "story" will be on MU's side of the fence. I have yet to see the "tale" RMBS will spin.

2. Once the judge and jury decide which "story" is the most logical and credible, they will find the "rules" of law they need to punish the illogical and incredible, thereby awarding victory to the best and brightest; and

3. With my Bird Brain and Mom & Pop approach I wouldn't want to sit for that quiz if I were Tate. Try as I might, I just can't imagine a "story" I could put before the jury with a straight face in answer to their questions on this point.
