One particular part of you magnum opus rings true today, namely this.

All the paid for with cash and cheap stock, but not disclosed "Research Reports" on ZSUN (another clear SEC violation which your crew have repeatedly abused) along with false press releases about deals with the likes of AOL et al will be of interest to the jury as well.

One might think it merely a coincidence, but let me assure one, especially one, Mr. Bryant Cragun, that due to our tireless efforts to unravel your operation and prove our complete innocence in court, we as a group(grouped by you, or rather by the fool you got our names from) have done much of the SEC's work for them, and we are just beginning to see the fruit's of these labors bloom forth. In the coming months I feel confident that tout sheet after tout sheet, company after company, that has made the mistake of associating with you will find itself exposed by the Feds.

As I predicted long ago, this is going to turn into a big squeelathon real soon as people give each other up to avoid the grey bar hotel. For those of you that find yourself in this position, let me advise you to read Den Of Thieves by James B. Stewart. It deals with the fall of Ivan Boesky and Michael Milken in the 80's. The interesting thing is that sometimes those guilty of more were actually punished less because they were gotten to early and were able to rat out others. Sometimes the almost completely innocent wound up punished the most because they were found out last and there was no one left for them to drop a dime on. Get smart.

I have been informed that any further posting here by myself or others might forever destroy the chance of settlement of the lawsuits associated with this company. Well so be it. If it behooves the plaintiffs in those suits to carry on because of this post, then by all means carry on. It will be my last post here regardless.

I thought I might take this opportunity to try to help others avoid the headache of being sued for doing like myself and using their 1st amendment right to speak the truth, so i'd like to go over the things that got me sued.

On May 14, 1999 Bryant Cragun named me as John Doe #6 in a lawsuit. Obviously one would think that I must have spoken negatively of this man or wronged him in some way to warrant such action. Well I’ll just list all my posts below where I had mentioned Mr. Cragun before this date

Ok, so that’s all it takes to get you sued. The first post was in response to a post of fellow “sue-ee” JJS64 showing a new Raging Bull tout, touting a stock that Cragun himself admits to being involved with. My post points out another tout on another Cragun involved stock. Pretty evil on my part. Actually pretty good to put the tout stamp on the dude after two posts. Check his profile now,

he’s still stuck on two Cragun stocks. The one that JJS64 had picked out was a 4 Cragun stock tout. Of course the other thing these stocks have in common is that they are pushed by the scummy offshore boiler rooms profiled first here on this very thread, and then months later on the front page of the Wall Street Journal, but I’m sure that’s all a coincidence.

Now as for the second post, I think that’s a lot more telling as to why I got sued. You see that whole posts is a small partial list of the many lies, threats and distortions of one Francois Goelo during his early tenure as head ZSUN tout, and leaker of news. The stock boards were a whole different place a year+ ago. For the most part, people were a lot more intelligent. Back then, you show the average investor a few scummy things about his investment, and the light bulb would go on inside his head. Now a year later, you utter the slightest negative thing about a company and you are either an evil short or a paid basher, paid by evil market makers that are naked short a bazillion shares of whatever pet turd you’re invested in. The company is 100% legit but it’s stock doesn’t quadruple as promised because of the evil MM’s, etc. etc. etc.
A year ago there was really very little of this wacko conspiracy crap outside of maybe psychic detective Riley G.. Only the most gullible of fools bought into it and preached it to the masses. Of course one of these fools was Francois Goelo. He has used this line of crap time and again to explain the down drafts or poor performance of his crapulent stock picks. Never mind the insider sales, or insiders with shady pasts, the below market private placements(that he’s taken part in), reverse mergers, accounting irregularities, SEC actions, the generally poor financial conditions or ludicrous business plans of these companies. Nooooo, can’t be those thing, it must be either 1. Evil shorters, 2. Evil nekkid Canadian Shorters, 3. Evil nekkid shorting market makers. Those are the only reasons for an OTCBB stock to ever go down.

If you read the early days of this board you will see myself and other members of the “ZSUN8” kicking the offshore crap out of Francois. This was something he wasn’t exactly used to, and he still hasn’t gotten used to it to this day. When Francois gets beat with the facts, like he always does, he starts calling names or threatening lawsuits or even bodily harm. He basically has no scruples. It’s pretty clear here that Francois is the one that helped pick the ZSUN8 out. Here’s part, keep in mind I say part, you never see all my hand here, of the evidence that it was Francois that got all of this going.
1. We have Francois admitting in post number #925 on April 26 of last year to having spoken to Cragun on a “couple of occasions.”
2. Cragun’s lawsuit starts everything with “plaintiff is informed and believes, and on that basis alleges.” Yes this is legal mumbo jumbo, but also true, someone informed Cragun of all the hogwash he put in his suit. Hogwash such as there being a scheme by short sellers to attack all of his stocks, or that defendants are either short sellers or persons working in concert with short sellers. As far as ZSUN or any other Cragun stable company I am neither, never shorted either one, and the only compensation I have ever received was from Ziasun and Cragun themselves. They have each rewarded me with an education in OTCBB stocks that I could get nowhere else.
3. Something that shows it was in fact Francois that informed and lead Cragun to believe. How about the fact that in the Cragun motion for restraining order there is a whole section on “Walking a stock down.” I wonder which offshore dwelling stock tout used to really lay it on thick about stocks being “walked down.”

The moral of the story is, if you don’t want to be sued, never have an opinion. If you are foolish enough to develop an opinion, especially one that goes against the crowd, be sure and keep it to yourself. Also be wary of scummy people from the Cayman Islands. You know all along I and other ZSUN8’ers(and I think it’s clear to the investing public as well) have said that the biggest mistake that ZSUN or Bryant Cragun ever made was to pursue litigation against us, and thus force us to dig even deeper for the truth. Now I wonder if perhaps the biggest mistake these people made was in taking advice from Francois Goelo. If not for Francois urging the lawsuit, and constantly keeping us posting here with his lies and or deception filled post, there’s little doubt ZSUN and Cragun would not be in the position they are in. So I guess another moral of the story might be when some wacko from the message board advises your company to sue it’s critics and even tells you who to sue, don’t take his advice.

I am a couple of mouse clicks away from having a printout of the settlement agreement. Soon I will sign and return it. Like I said, this very post may have shot down the chance for settlement. If so, then so be it. It would be very foolish on the part of my opposition, but it’s a free country. Obviously if a settlement is signed off on by all parties I’ll no longer be posting here, by terms in the settlement. What’s not in the settlement is I’ll no longer post as CM Burns period, no matter what the thread as it’s getting kind of boring. If on the other hand, no settlement is reached, I’ll still refrain from posting here, as like I said it’s boring and like the Truthseeker posted, the truth’s out there. Thanks to our efforts here, anyone that wants to know the truth can easily find it on this very thread.
However that said, allow me to issue a bit of a Don Corleone warning. I’m a superstitious man. If I’m not barred by settlement, and say for instance 5 names all sign up on SI all the same day and start touting ZSUN or other broken down glue factory bound Cragun stable companies, then I will likely be forced to return. If someone gets the Power of Randy(Berg) bestowed upon them and can see the near future where press releases or analyst coverage is concerned, I will likely return. And of course if/when John Reed Stark ever blesses this thread with his presence I will return. Things that will not invoke my return are stupid touts posting and then touting misleading press releases, or talking about all the great inside info. they have about Softbank buying ZSUN or other such numbskullery. Crap like that obviously does more harm than good and if I was running a legit company I would be suing those people.

In closing, it’s been a great pleasure to be a part of all this, the education I have received has been priceless. Now it is time for me to apply it.

LOS ANGELES--(ENTERTAINMENT WIRE)--Sept. 12, 2000--A federal court in Los Angeles has entered a complete defense judgment in favor of Playgirl magazine in a case brought by a former model in the magazine.

The magazine was represented by Kent R. Raygor of Sheppard, Mullin, Richter & Hampton LLP in Los Angeles.

Berto Luna, a self-described lifeguard/bodyguard who posed for the November 1993 issue of Playgirl magazine, sued the magazine in October 1998 claiming that Playgirl had violated his privacy and appropriated his likeness without compensation by using his nude photographs in subsequent issues.

The court ruled in favor of Playgirl and against Luna on all claims. Luna was also ordered to pay Playgirl $68,678.20 as partial compensation for the attorneys' fees and costs it had to incur in responding to Luna's lawsuit.

In an unusual twist, the Court also sanctioned Luna's attorney, Jeffery Rubenstein, for his bad faith litigation of the case and ordered him to personally pay Playgirl $40,630.70 to partially compensate it for the fees and costs it suffered due to his conduct during the litigation.

In making that ruling, the Court stated: "Attorneys have the responsibility to represent their clients vigorously. But they also are required to avoid subjecting opposing parties, opposing counsel and the court to vexatious, rule violating misconduct.

"Unfortunately, this case exemplifies the disastrous consequences that can result to a client and opposing parties and counsel when an attorney fails in a most blatant manner to discharge these responsibilities."
