They did.

I find it interesting that the attitude of many here is that Microsoft should have settled no matter what.

If you were accused of a crime you felt you didn't commit, would you settle? What if the DA's offer didn't seem fair? Am I the only one here who watches Law & Order?

The settlement is very unlikely unless SC decides not to take the case. If the case goes to appeals court, DOJ better settle, otherwise, this thing could drag on forever. The urgency DOJ displayed in asking the SC to take the case wouldn't gel with the time taken to get results. So, they are in driver's seat till the SC decides what to do and possibly even afterwards if SC decides to take the case. Till then, there is no reason for them to settle.

Your comments about "Ballmer and Gates were drinking to much wine" is grammatically wrong and factually couldn't be farther from truth. The problem then was that the DOJ was in driver's seat and wanted too much; this is still the case. So, settlement was impossible.

It is interesting that you have come to the same conclusion as myself about "the longer the better for MSFT's competitors". The overhang of the case will be a problem if it continues on for a couple of years...

Bob, I dont feel the need to split them up is as urgent as you think. Perhaps Justice is feeling pressure from the top. We all assume that Clinton/Gore is pro-justice on this one. They might be as far as sanctions go but i doubt they want a split up of the co.
