Since many states have there own minimum wage already, would you make an issue of that for the sake of conformity? I don't think there is a Constitutional leg to stand on...

You mean re: Living Wage? Sure there is. Same constitutional leg the Federal Minimum Wage is standing on now. Essentially the Living Wage is simply the Minimum Wage adjusted to the Federal Poverty Line and adjusted for local conditions.

And to get broad based support for the elimination of the EIC you'd have to be able to guarantee that the Living Wage would apply across the board, across the country...thus eliminating the cost of administering the credit (and the fraudulent claims) entirely. Supporters and pols won't agree otherwise.
