No he doesn't.

I'll reiterate this one more time and let it drop.

It is not against the law to accept payment for order flow. Knight Securities does it. Herzog does it. Sherwood does it. They are very upfront about this. To imply that it is even subject to interpretation of the 1940 Act is absurd. If it was against the law, the SEC would have acted years ago, because nobody is doing anything to hide this payment.
