I agree with you broadly on this issue of the death penalty.
Most of us are aware of the weaknesses in our judicial system. I do not have all the answers for how to rectify these matters but they definitely need to be addressed in an apolitical atmosphere. There is far too much hysteria over drugs and crime. There are far too many people in the prisons. We are establishing an American Gulag because of populist hysteria.

One of problems with an automatic death penalty for drug pushers is highlighted by the recent revelations of the LA police framing hundreds of people in LA. Another problem is the conviction of innocent people of murder because of lack of adequate criminal defense. This has been pointed out by the number of people on death row shown to be innocent by DNA testing. Usually, these people are too poor and ignorant to deal effectively with a legal system out to convict them. There are many other problems connected with these issues. The death penalty is justified under certain circumstances where there is unequivocal proof of guilt involving multiple credible eyewitnesses and convincing physical evidence where the accused is and will remain a continuing threat to society at large. Without these higher standards innocent people usually poor will continue to be murdered by the state.

Incidently, the "three strikes law" has produced a number of ridiculous life in prisons terms. This law is sponsored and supported in California by the state prison guards.
This is no small conflict of interest. <G>
Meanwhile, 60% of the inmates of California prisons are infected with Hepatitis due to inadequate medical treatment.
