Re: "What happens when the appellate court surprisingly issues its first anti-MSFT ruling?"

There is much in Jackson's finding-of-fact ruling that is pretty much straightforward, non-overturnable fact, despite MSFT's bumbling quibbling in court. Watch for much of this to be upheld the Appeals Court.

There is also quite a bit of Jackson sneering at the Appeals Court. Watch for some sharp words toward Jackson from Appeals, without too much effect on the actual ruling.

As far as the remedy goes, I wouldn't venture to predict whether Appeals would uphold or overturn the breakup. Who knows? Maybe they'll even rule that the breakup should be into three parts, Ops, Apps, and Net. Maybe they'll nix the structural remedies and just impose a bunch of restrictions on MSFT's monopolization practices, and require DOJ to appoint a watchdog committee to set up camp in Redmond. There's no predicting what the remedies will be.

But there will be remedies, and in the minds of the Appeals Court, the remedies will rectify MSFT's illegal behavior. This will not be a picnic for MSFT shareholders.
