Re Hate Crime/War Crime Comparison:

Here is why it is not a good comparison. War Crime laws punish something that otherwise would not be illegal (i.e., but for the War Crime law, the perpetrator would be scot-free).

Hate Crime laws punish something that is already illegal and subject to severe punishment. It punishes something that otherwise IS ALREADY ILLEGAL.

So, with War Crime laws you are punishing OVERT ACTIONS (i.e., the perpetrator's ACTIONS are being punished).

With Hate Crime laws you are punishing STATE OF MIND (i.e., the perpetrator's actions were already illegal, he is subject to ADDITIONAL punishment because of his state of mind when he committed the actions).

Totally different concepts.
