I indicated up front it wasn't a perfect example. That's why I used the killing is expected in war/murder is expected in an imperfect society.

You also have to understand the persons charged with War Crimes against civilians have a laundry list of War Crimes against them from the outset beginning with waging an aggressive war and a war in violation of international treaties and agreements; illegal war in other words. Heinous act against civilians rarely occur in a vacuum.

Yes exactly...and judges often use intent (i.e. state of mind) in determining the severity of sentence. This is widely recognized and not new. Judges often bring the full wrath of sentencing limits down on the convicted and complain from the bench in open court that they couldn't provide harsher punishment particularly when torture is involved. A hate crimes law will give them better sentencing tools in many cases.

Thank you. You said it much better than I was able. Perhaps they should not have called it "Hate Crimes". Perhaps Biased crimes for them is a better fit.

Next they will need to categorize hatred. Let's see there will be Absolute Hatred, Supreme Hatred, Major Hatred, Moderate Hatred, Minor Hatred, Minimal Hatred and finally Subliminal Hatred. (The toughest one to prove as it only flashes briefly) Punishment will be tailored to each degree of hatred.

Once this is done they can take on ----"D-i-s-l-i-k-e"----!
