Too much tweaking around with element of motive in a murder is a dangerous step to created protected classes of humans in a society where no one's rights are greater than the next persons.

Your point is a valid one, but it raises a question: Doesn't it seem to fit the mould that a politician that promotes class warfare would be naturally inclined to have separate classes of penalties for the same crime?

Equality?????? Same only different, I suppose.

Hate crimes aren't all about murder- it's a judgment society makes about what is abhorrent. Defacing a synagogue, or a mosque or a church can be a hate crime- it isn't JUST about murder. Societies have the right to set their own limits on behavior- in the past it has been "PC" to target people for discrimination or even violence, because of race, or sexual preference, or religion- now the pendulum has swung the other way and it is criminal to do violence for the motive of class hatred- I think that's laudable. It is criminal to do all violence, but I have no problem with singling out class violence for special treatment. We have always differentiated between crimes, based on planning, motive, competence etc- I no longer have a problem with hate crimes.

This savage joke about homosexuals was posted on the Elian thread. I thought it was brutal and sick and wrote to the webmaster to tell him that it should be removed. The fact that it is still there is sickening. In my opinion that joke is hate speech. And it is not all right to talk about any class of people in that way. If you are homosexual in this country some people think they are entitled to talk about you in that way. And some people think it's ok to beat you up. If you are a heterosexual I don't think you are singled out for hatred in that way. I don't think people are waiting to beat you up on the street for kissing your girlfriend or wife in public. When homosexuals do not face greater violence in our society they will not need greater protection. It is OUR fault as a society that hate crime protection is necessary- it is not the fault of the victims.
