You can say they have "equal protection under the law" but the words are meaningless if whole classes of people aren't actually protected. I would argue that has been the case. You obviously think judges have enough latitude- I would argue they had enough latitude for years, and did not use it. So I would have to respectfully disagree with you. I understand your position- it used to be my own.
