It could be that the left will say that gangs won't "qualify" because members "choose" to belong to the group..... a simple matter of choice, not like color or ethnics. Hmmmmmm, I wonder if there is a "gay gene"?

Yes. It's too narrow. When people make a choice to affiliate in criminal groups created primarily for the purpose of criminal activity and violence- there is NO public policy reason to protect those "classes". I can see a public policy reason for protecting religious freedom, or nationality, or ethnicity, or sexual preference, or marital status from victimization- I see no public policy for protecting gangs. Sorry.
