I can't believe that farmers are too stupid to incorporate their farms. Of course, some midwestern states have tried to make foreign owned corporate farming illegal. Since corporations can be immortal, the farm assets themselves never pass through probate. If one incorporates in a tax shelter like the Cayman Islands and holds the stock in an overseas trust for the heirs the stock never goes through probate. The corporation can establish income tax advantaged pensions and stock options to provide income for the farm couple. But have you ever tried to get a farmer to plan beyond his next crop?
