Lexar Media C.C. notes

To limit Lexar Media's exposure to patent infringement John Reimer stated that he plans to transition the entire product line to the work-around product and this will occur before the end of the year or sooner.

I am uncertain, but I think this speaks only to new products coming off the assembly line. I previously assumed because of these statements that they were going to replace channel products. This assumption is probably wrong, but it was not specifically addressed. The concern would be the magnitude of the exposure Lexar Media shareholders would be asked to bear if all the channel supplies currently on shelves for the holiday season and the January aftermarket purchases were found to infringe.

Here are some quotes.

"...in fact we are at this point beginning manufacturing at this very moment, indeed."

We are happy with lab tests that are completed in "functionality, reliability and compatibility".

Work around product should be "invisible" to users.

"Of course, you know, I should add that noone can predict, you know, the outcome of the trial situation with SanDisk. If everything, you know, were to go entirely against us relative to timing there could be some disruption in the transition, but at this time we are quite comfortable and we don't expect that to occur."

Q: "If manufacturing is beginning today do you plan to transition your entire product line over to this new work around product say in the next 30 or 90 days or is there some time line you are shooting for in order to incorporate these changes in production."

A: "...the transition will occur completely by the end of the year or sooner."

Q: Any movement to an out of court settlement?

Lexar believes the judge's ruling this week is "significant" despite SanDisk's position statement that was released this week. SanDisk's conduct before the standards bodies needs to be investigated further. "We think the stakes have gone up considerably" due to the recent judge's ruling.

"The validity of this particular patent has some serious questions" and Lexar is anxious for the "cover to come off" of the protective order regarding our argument against the patents validity.

No other media types or international sales are affected by this patent. The implication here is that Memory Stick is not in jeopardy.

Nobody asked Mr. Reimer about this court decision and whether the redesign has been reviewed by SanDisk.

Also I would have liked to know whether the redesign will need to be assessed regarding potential infringement as well. I would have liked to know if the redesigned product would have to be resubmitted for approval of the CFA. I would have liked to know whether OEM's using the redesign product would like to requalify the product, etc... This was not asked.
