I am glad you asked about court transcripts.

I found a service called "RFC Express" which locates a summary of the filings on the docket that have been made to date. There are restricted and unrestricted documents available for each separate filing. Because they charge by the page I was selective in what I had photocopied and mailed to me. I believe that Dan Auclair and one of the SanDisk legal representatives present during one of the unsuccessful SNDK/LEXR cross-licensing meetings testified in a deposition that Mr. Reimer admitted to them that he was aware that '987 was infringed. I don't know when he reportedly made this statement, but I think it was in 1998 or 1999.

I don't want to say specifically what was said because it has been a year or so since I reviewed the information. It was my (albeit biased) impression that these statements helped fortify SanDisk's stance that '987 was "wilfully infringed" as is also echoed in Lexar's SEC registration statement.

Realize that I have no legal training and the importance of Mr. Reimers alleged admission is unclear to me.

(The fact that one of the SanDisk lawyers testified on this issue seemed important at the time as the whole issue about "lying under oath" was topical given the (at that time) recent discussion re: President Clinton. I am guessing a lawyer convicted of purjory (sp?) could be disbarred in the State of California.)

If you would like a copy of the docket to date (dating back to SanDisk's original filing) you may call RFC Express at 1-800-243-1770 and request it. I think there is a minimal charge to have the docket summary faxed and a steeper charge for individual documents based on a per page fee.

Mike Gottesman somehow has either an on-line access or e-mail alert in place. He actually learned of the infringement judgement last April before anyone else knew about it as it was available on-line early and he happened to tap into the information from the East Coast before anyone on the West Coast was awake!
