Hypothetically, of course, suppose a court appointed attorney in a death penalty case was known to sleep during the trial. In fact that attorney had a record of sleeping during trials. Would that cast doubt judicial objectivity? Would that cast doubt on a guilty verdict? If the Governor of a state attempted no remedial action, would that suggest that the Governor of said state, had no interest in preserving the integrity of the prosecutorial/judicial system?
