I have served as an election judge. People spoil ballots all the time. Usually, they catch it. Sometimes the tabulator catches it. And, I would imagine, sometimes people do not do anything obvious (like over- vote) and end up voting for those they did not mean to. Besides, how would one even prove it had happened, since ballots are anonymous? It should be a non- starter, unless the faulty design is evident to the average person......
