Like you, I first heard about the statute and thought- well, there. That's the answer.
But there's more to it--- they just were talking about this on NBC and said that that statute applied to handcounted balloting, and not to machine- and that the wording leaves "wiggleroom" for the designers. The wording is something like- "conform to the handcounted ballot as much as is practicable"
Just the kind of technicality lawyers love..
ALso Flap's statements are scurrilous- saying that Rep ordered that ballot to confuse older people- the ballot was designed by a Dem who thought it could more easily be read by seniors because of the larger print. She sounds devastated by all this.
ALso on TV-- the Cook COunty judicial ballot is a butterfly and it is REALLY small print- I thought it looked much harder to read! This makes Daly look hypocritical to me.
