No judge has ruled on anything yet. But, if you read the Florida statute (a copy of which can be found on CNN's website), it is clear that the ballot did not conform with statutory requirements. Period. Whether it has been used before or not is irrelevant. The statute has never been repealed.

As for remedies, there are many. From tossing out those ballots that went to Buchanan to having a whole new re-vote. That's what the judge will determine.
