JMHO, but Federal law sets the 1st Tuesday in November as the date for the Presidential election. Although the registration, appearance of the ballot. method of voting (machine, paper, etc), are left to state law, the date of the election is not. I believe that the Supremacy Clause of the Constitution would deprive a state court of the authority to order an election (other than on the 1st Tuesday in Nov) for the office of President. Of course, the state court can validate or invalidate ballots, order recounts etc. However, the timing of the popular vote, the vote of the electoral college, and the certification by Congress is not subject to the whims of a state court.

Thus, IMHO, a re-vote in Florida is not a realistic option.

And what about the people in the Panhandle who said they headed home instead of the polls when they herd Gore won FL?

Why only those who voted in PB County, why not include all the registered voters in PBC? They could say they were confused and couldn't find their way to the polling place...and on and on....

Let me remind you. The overseas absentee ballots are not a given for Bush especially with Leiberman on the ticket and American Jews holding dual citizenship/living abroad...

The solution is to redo the election in Florida, allowing all voters from the previous election to cast their votes under carefully monitored conditions.

Scumbria-

Ain't gonna happen. We Dems are on the wrong side of this fiasco. Best to swallow the medicine and get on down the road.
