I believe what their suit(Cobalt Blue clarify please) is saying is that by doing a manual recount, ADDITIONAL ballots that were not included in the first count because the machine may/could not read them would be included.

Because those NEW votes would be included, it would therefore dilute the votes of those whose votes were counted in the original tabulation. They consider that dilution to be a violation of 14th Amendment rights.
