The reason for that Texas law is that the vast majority of Texas counties use (more up to date) optically read ballots which are often misread by the machine if they are marked outside of their tolerance limits. The human eye can adjust for this problem easily.

Anachronistic punch card ballots (still used in a few Texas counties) can be tricky for both humans and machines to read when the chad hasn't been fully removed from the hole. Machines impartially read "no vote". Humans read which ever way works out best for their candidate. <g>
