Gore Launches First Direct Court Action in Florida

WASHINGTON (Reuters) - Democrat Al Gore (news - web sites)
on Monday launched his first direct legal action in the fight to decide last week's indecisive presidential election, joining a Florida county's lawsuit to extend Tuesday's deadline for vote certification.

Gore communications director Mark Fabiani said the vice president's legal team had joined the lawsuit filed by Florida's Volusia county against the deadline of 5 p.m. on Tuesday set by Florida's state secretary of state.

``The county filed the suit in state court and we joined it,'' Fabiani said.

The deadline would prevent a hand recount of votes in some counties where it is believed Gore might have done well enough to give Gore the victory over his Republican rival George W. Bush (news - web sites), who lost a court action earlier on Monday to have the hand count stopped. The state would continue counting overseas absentee ballots through Friday.

``The citizens of Florida deserve an accurate and speedy count. The Secretary of State, a crony of the Bush brothers, is trying to steal this election away and no one is going to stand for such a naked political act,'' Fabiani said.

Earlier on Monday, Florida's Republican Secretary of State Katherine Harris announced she would enforce a Tuesday deadline set by state law to certify the state tally which Bush currently leads by fewer than 400 votes -- a move that threatened Gore's chances of winning the presidency.

The law allows the deadline to be extended in special cases at the secretary of state's discretion. But Harris, who was part of the Bush campaign, refused to allow an extension.

Ratcheting up the rhetoric, Gore press secretary Chris Lehane charged the Florida secretary of state ``is trying to do an end run that would frustrate the will of the people, much as the Bush campaign tried to give the American people the bum's rush a couple of days ago'' when it sought an injunction to stop the hand count.

In a victory for Gore, a Miami federal judge refused the request by Texas Gov. Bush's campaign to halt a manual recount of ballots from Florida counties.

``She (Harris) is acting in the finest tradition of a Soviet commissar,'' Lehane said.

Fabiani said he was in contact on Monday with Gore and said, ``He is fine. He is convinced that he won the vote in Florida, just as he won the national vote.''

``He is looking forward to a speedy hand recount of the vote, but that can be completed only if the Bush brothers and their political cronies get out of the way,'' Fabiani said, referring to George W. Bush and his brother, Jeb, who is governor of Florida.


Gosh....Can anybody pick out an instance of partisan name calling in this article? Nice to know we're sticking to the high road here.

So, J D B: What's to stop getting the extension via state judge mandate? that would force Bush to appeal to the higher (federal) court, wouldn't it - except that, as you say, it's already out of play.
