Thanks for the reminder that florida is subject to the U.S. constitution. Of course I am sure you are aware that the federal constitution grants only limited powers to the federal government. My point, I believe, was that Bush stated no colorable claim under the 14th amendment, a point you haven't even tried to refute. Judge Middlebrooks didn't even have to retire to his chambers to dismiss this. You will find his opinion on the cnn web site stating that there is no consitutional claim here and that this is entirely a matter of Florida state law. Please go read it and enlighten us as to how he is wrong. If Gore or Daley try to raise constitutional claims herethey will have no better luck although they could use the same arguments that Bush tried to put forth.
